Scope and acceptance
These terms govern access to and use of the XPERYO service, and the purchase of subscriptions and credits. By creating an account or placing an order, you accept them. If you use XPERYO on behalf of an organization, you confirm that you are authorized to bind it.
Who we are
XPERYO is published by XPERYO (business being registered). Address: Morocco. Registration: in progress. Contact: contact@xperyo.com. In these terms, “we” means the publisher and “you” means the user.
The service
XPERYO is a learning app available at go.xperyo.com and on mobile. It lets you create courses with the help of artificial intelligence, run live quizzes, conduct business simulations and follow learners’ progress. The features available depend on your plan.
Your account
- You must be at least 16 years old to create an account. Younger learners may only use XPERYO through a school or trainer that has obtained the required permissions.
- The information you provide must be accurate and kept up to date.
- You are responsible for keeping your credentials confidential and for activity under your account. Tell us promptly about any unauthorized use.
Plans and AI credits
The Free, Pro and Organization plans, their prices and their limits are described on the pricing page. Limits are enforced by the service: an action that would exceed your plan is refused with a message explaining why.
AI features consume credits. There are two kinds:
- Included credits come with a paid subscription. They reset at each renewal and do not carry over.
- Purchased credits come from a pack. They do not expire while your account exists.
The number of credits used depends on the work the AI actually performs. An estimate is reserved when a generation starts and adjusted when it ends; a failed generation is credited back. Credits have no cash value and cannot be exchanged for money or transferred to another account.
Orders and payment
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our web orders. Paddle processes the payment, issues the invoice, collects applicable taxes and provides customer service for payment inquiries. The Paddle buyer terms apply to your order in addition to these terms.
Prices are shown in US dollars, excluding tax. Paddle calculates and adds the VAT or sales tax of your country at checkout, and may display prices in your local currency.
Purchases made in the iOS or Android app are processed by Apple or Google under their own terms, including for billing and refunds.
Term, renewal and cancellation
- Subscriptions are monthly or yearly and renew automatically for the same period, at the current price, until cancelled.
- You can cancel at any time from your account settings or from the link in Paddle’s confirmation email. Cancellation takes effect at the end of the period already paid; your account then moves to the Free plan.
- On the Free plan your content is kept, but creation features are limited to what that plan allows.
- We may suspend or close an account that breaches these terms, after notifying you unless there is an emergency or a legal obligation.
- You can delete your account at any time from the app. Deletion is permanent.
Refunds and withdrawal
You can request a refund of a subscription’s first payment within 14 days without giving a reason, and of an unused credit pack. Full details are in the refund policy. It does not limit the rights granted to you by the law of your country of residence, including a consumer’s right of withdrawal.
Your content
You keep ownership of the content you upload or create in XPERYO: courses, questions, scenarios, documents and answers. You only grant us the right to host, copy, process and display it as needed to run the service for you and for the people you share it with. This right ends when the content is deleted, subject to the backup periods described in the privacy policy.
You confirm that you hold the necessary rights to the content you publish and that you are authorized to process your learners’ data.
AI-generated content
Content produced by AI may be incomplete, inaccurate or similar to existing content. You must review it before publishing it or using it to assess people. Subject to third-party rights, you may freely use the content generated for your account. Do not send the AI sensitive data or personal data you do not need.
Acceptable use
You must not use XPERYO to:
- publish unlawful, hateful, harassing or violent content, or content that infringes others’ rights;
- try to access other users’ accounts or data, or bypass plan limits and access controls;
- disrupt the service, reverse engineer it or use it in an automated way without our consent;
- resell the service or credits without our written consent;
- generate content intended to deceive, defraud or impersonate someone.
Intellectual property
The XPERYO software, brand, logo, design and own content are protected. We grant you a personal, non-exclusive, non-transferable right to use the service for the life of your account and within your plan. No other rights are granted.
Availability
We make reasonable efforts to keep XPERYO available at all times but cannot guarantee it: interruptions may occur for maintenance, updates or a provider incident. The service evolves; we may add, change or remove features. If removing an essential feature materially reduces your paid plan, you may cancel and receive a refund for the remaining period.
Liability
To the extent permitted by law, our liability is limited to direct and foreseeable damage and, in total, to the amounts you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect damage, such as loss of revenue or data, or for how you use AI-generated content. These limits do not apply in case of gross negligence or wilful misconduct, or where mandatory law prohibits them.
Personal data
How we process your data is described in the privacy policy. When an organization uses XPERYO for its learners, it is the controller of their data and we act as its processor; a data processing agreement is available on request.
Changes to these terms
We may change these terms. For material changes, we notify you by email or in the app at least 30 days in advance. If you do not accept the new terms, you may cancel before they take effect; continuing to use the service afterwards means you accept them.
Governing law and disputes
These terms are governed by Moroccan law. If you disagree with us, first write to contact@xperyo.com: we will look for an amicable solution within 30 days. Failing that, the dispute will be brought before the competent Moroccan courts. If you are a consumer, you keep the protection of the mandatory rules of your country of residence and may bring proceedings in its courts.
